Rule 20AS - Carriage of Handicapped Passengers

Non-ambulatory/physically handicapped passengers, as defined in (C)(1) below, will be accepted for transportation without an attendant, as long as provisions in paragraphs (C)(2) and (3) below are met and maximums in paragraph (D) below are not exceeded.

  1. Definitions:

    Nonambulatory - Persons who are unable to walk or need the support of another person to walk, but who are otherwise capable of caring for themselves without assistance throughout the flight. If a passenger can walk without aid or another person, the passenger is not considered to be nonambulatory, regardless of degree of impairment. If a passenger uses a wheelchair for convenience, passenger is not considered nonambulatory. A child is not considered a nonambulatory passenger unless the child has a restricting physical handicap, other than age.

    Self-reliant - A person who is independent, self-sufficient and capable or taking care of all physical needs during flight, and who requires no special or unusual on board attention beyond that afforded to the general public, except that assistance in boarding and deplaning may be required.

    Non-self-reliant - A person who is incapable of self-care during a flight. Determination of self-reliance as will accept the disabled person's determination as to self-reliance.

  2. Conditions for Acceptance - Reservations: Reservations must be made 24 hours in advance of travel, advising the carrier as to the nature of the handicap and assistance required. Carrier will make every reasonable effort to accommodate passengers who fail to make reservations 24 hours in advance but will not be obligated to do so.
  3. Other Conditions
    1. The non-ambulatory passenger's physical size or condition must permit movement through the aisle at floor level.
    2. Carrier will refuse to accept a passenger who is unable to sit in a seat with seat belt fastened.
    3. Carrier will provide or make whatever arrangements are necessary to assist passengers in boarding and deplaning. Any expense necessary for outside services will be borne by the passenger.
  4. Maximum acceptable number of non-ambulatory and/or physically handicapped passengers the table below provides the maximum number of unaccompanied (except as indicated below) non-ambulatory/physically handicapped passengers the carrier will accept for transportation on any one flight.

    Note: For the purpose of this rule, incapacitated or handicapped passengers are passengers who would require assistance to evacuate the aircraft during an emergency.

  1. AS will accept the determination of a person with disability as to self-reliance.

Rule 25AS - Refusal to Transport - Limitations of Carrier

AS may refuse to transport, or may remove at any point, any passenger:

  1. Government Request or Regulations - Whenever such action is necessary to comply with any government regulation, or to comply with any governmental request for emergency transportation in connection with the national defense, or whenever such action is necessary or advisable by reason of weather or other conditions beyond its control (including but without limitation, acts of God, force majeure, strikes, civil commotions, embargoes, wars, hostilities or disturbances) actual, threatened, or reported.
  2. Passenger's Conduct or Condition - Whose conduct, status, age, or mental or physical condition is such as to:
    1. Make such refusal or removal necessary for the reasonable safety or comfort of other passengers, or
    2. Involve any unusual hazard or risk to himself or to other persons (including, in cases of pregnant passengers, unborn children) or to property.
    3. Carrier will accept the determination of a person with disability as to self-reliance.
  3. Search of Passenger or Property - Who refuses to permit search of his/her person or property for explosive or a concealed deadly or dangerous article.
  4. Proof of Identity - who refuses on request to produce positive identification. AS shall have the right, but not be obliged, to require positive identification of persons purchasing tickets and/or presenting a ticket(s) for the purpose of boarding aircraft.
  5. Across International Boundaries - who is traveling across any international boundary if:
    1. The travel documents of such passenger are not in order.
    2. For any reason, such passenger's embarkation from, transit through, or entry into, any country from, through, or to which such passenger desires transportation would be unlawful.
  6. Comfort and Safety
    1. Who fails or refuses to comply with AS's rules and regulations.
    2. In the following categories where in AS's sole judgment refusal or removal may be necessary for the comfort and safety of themselves or other passengers:
      1. Persons whose conduct is or has been disorderly, abusive, violent belligerent and/ or irrational so as to be a hazard or potential hazard to AS employees or other passenger(s).

        Note: AS will accept the determination of a person with a disability as to self-reliance.

      2. Persons who are barefoot or who have uncovered torsos, except the midriff, which may be uncovered.
      3. Persons who are unable to sit in the seat with the seatbelt fastened.
      4. Persons who appear to be intoxicated or under the influence of drugs.
      5. Persons who have an offensive odor (such as from a draining wound or improper hygiene) or have a contagious disease provided it is not the result of a handicap.
      6. Persons who are mentally deranged or mentally incapacitated. However, as will accept escorted mental patients under the following conditions:
        1. The requesting medical authority furnish assurance, in writing, that as escorted mental patient can be transported safely.
        2. Only one escorted mental patient will be permitted on a flight.
        3. Request for carriage is made at least 48 hours before a scheduled departure.
        4. Acceptance is for online travel only.
        5. The escort must accompany the escorted passenger at all times.
      7. Persons who wear or have on or about their persons concealed or unconcealed deadly or dangerous weapons; provided, however, that AS will carry passengers who meet the qualifications and conditions established in F.A.R. Part 108.15.
      8. Manacled persons in custody of law enforcement personnel or persons who have resisted or may reasonably be believed to be capable of resisting escorts.
      9. Unaccompanied passengers who are both blind and deaf, unless such passenger is able to communicate with representatives of as by either physical, mechanical, electronic, or other means. Such passenger must inform as of the method of communication before use.
      10. Passengers who cannot control their bodily functions or need special medical surveillance due to their condition unless accompanied by an attendant who can provide the necessary service.
      11. Persons who attempt or have attempted to interfere with any member of the flight crew in the pursuit of their duties.
  7. Recourse of Passenger: The sole recourse of any person so refused carriage or removed en route for any reason shall be recovery of the refund value of the unused portion of his ticket from the carrier so refusing or removing, as provided in Rule 90(D).
  8. Nonambulatory Passengers - Persons who are unable to walk or need the support of another person to walk, but who are otherwise capable of caring for themselves without assistance throughout the flight and persons with impairments or physical disabilities which would cause them to require special attention or assistance from carrier personnel will be accepted for transportation without an attendant subject to the following conditions:
    1. Reservations must be made 24 hours in advance of travel advising AS as to the nature of the handicap and assistance required. AS will make every reasonable effort to accommodate passengers who fail to make reservations 24 hours in advance, but will not be obliged to do so.
    2. The passenger must be able to occupy a cabin seat in an upright position. An Orthotic Positioning Device (OPD) may be used if it does not impede any other customer's access to the aisle and the seatbelt can be secured around the person as the primary method of restraint.
    3. AS will provide or make whatever arrangements are necessary to assist passengers in boarding and deplaning.
    4. Any expense necessary for outside services will be borne by the passenger.
    5. AS will determine where passengers and escorts will be seated for the safety and comfort of other passengers. Two nonambulatory passengers will not be seated across the aisle from each other in the same seating row and never next to an emergency exit.
    6. Nonambulatory/physically handicapped passengers must be present to be preboarded without delay of aircraft. The maximum number of unaccompanied nonambulatory/physically handicapped passengers as will accept for transportation on any one flight shall be equal to the number of floor level exits available on the aircraft to be used, (see paragraph D).
    7. Nonambulatory/physically handicapped passengers may be refused transportation on certain aircraft types (having seating capacity of 19 seats or less) based upon the sole judgement of Alaska as to whether safety standards for all passengers can be maintained during normal flight operation or an emergency situation.
  9. Stretcher Passengers with Advance Arrangement: Stretcher passengers are acceptable for transportation on AS flights under the following conditions and with some restrictions:
    1. Stretcher passengers will not be accepted on Substitute Service Flight series 1000 or 2000 or 4500 or 4700.
    2. A medical release health certificate must be provided by the physician.
    3. Passenger or hospital must provide a Stokes or a Ferno 71 stretcher. These are basket type stretchers that are used for most rescue situations. Both Stokes and the Ferno 71 have heavy duty tubular aluminum frames that are permanently attached to a high density polyethylene shell.The Stokes litter is manufactured by Life Support Inter National, Inc. in Bristol PA.The Ferno 71 litter is manufactured by Ferno-Washington, Inc. in Wilmington, OH. These are the only types of stretchers certified for Alaska Airline flights.
    4. The stretcher passenger must be accompanied by at least 1 able-bodied attendant approved by the attending physician.
    5. Any advance arrangements necessary for outside services, such as loading and unloading, or ambulance service will be the responsibility of the passenger. The associated expense will be borne by the passenger
    6. .
    7. Transportation may be refused if booking party cannot provide the name of ambulance service meeting the stretcher on arrival.
    8. Charges for stretcher service are found in the Rule No. 500
  10. Acceptance of Children
    1. Accompanied children under 13 years old are accepted for transportation when accompanied on the same flight and in the same compartment by a passenger at least 18 years old or their parent.
    2. Unaccompanied children - unaccompanied age of child at last birthday via all classes of service:

      Under 5 years old: Not accepted under any conditions.

      5, 6, 7 Years old:
      1. Accepted for online transportation (nonstop or direct flights only).

      8 yr. old through 12 yr. old
      1. Accepted for online transportation (nonstop, direct and connecting flights)
      2. Accepted for interline transportation only provided space has been confirmed to the first point of stopover or to point where the child is to be met by parent or responsible adult upon deplaning.

      13 through 17 yr. old: Accepted without restrictions.

      NOTE 1: On-line transfer (any AS designated flight):
       
      • 2 hours or less - AS personnel will transfer
      • More than 2 hours - AS will not transfer. Arrangements must be made by the responsible adult for a family member/friend to make the transfer.

      NOTE 2: Interline transfer - AS will not transfer unaccompanied children to other airlines. Arrangements must be made by the responsible adult for a family member/friend to make the transfer. Exception 1: via AS, flt. 2000-2999 (Horizon Air), 3200-3274 (PenAir), or flight 4800-4899 (Era Aviation)
       
      • 2 hr. or less - Horizon/Era personnel will transfer children interline.
      • More than 2 hr. - Horizon/Era personnel may transfer children interline when connecting 2 hr or more. The reservations department will contact the connecting Horizon Air/ Era Aviation station personnel for final approval.


      NOTE 3: Children (5-12 years old) must be brought to the airport of departure by a parent or responsible adult who must remain in the boarding area until the child's flight has departed and who must furnish the carrier with satisfactory evidence that the child will be met by another parent or responsible adult upon deplaning at his/her destination. The child will not be accepted if the flight on which the child holds a reservation is expected to terminate short of or by-pass his/her destination. Exception 1: Unaccompanied children must not be booked on the last connecting flight to destination, or departing between 2100 and 0500, unless it is the only flight of the day - and - there are no weather problems at the destination.
    3. A Guardian Contact Form provided by Alaska Airlines, must be completed and signed by the parent or guardian of a child under the age of 13, and must include the following information:
      1. The name and phone number of the adult who brings the child to the origin airport
      2. The name and phone number of the adult who will meet the child at each stopover point and at the destination point. NOTE 1: AS has the right but is not obligated to require identification of the responsible party meeting the child at a transfer point or final destination. NOTE 2: Alaska does not assume any financial or guardianship responsibilities for unaccompanied children beyond those applicable to an adult passenger.
    4. Escort service for unaccompanied children 5-12 years of age: A USD 75.00 surcharge will apply when a trip consists of a non-stop, direct, or connection itinerary.
      • NOTE 1: Via AS flt. 3200-3274 (PenAir), a USD 30.00 surcharge will apply for travel solely on AS 3200-3274 series.
      • NOTE 2: Via AS flt. 4800-4899 (Era Aviation), a USD 30.00 surcharge will apply for travel solely on AS 4800-4899 series.
      • NOTE 3: One applicable surcharge shall be applied to a maximum of 3 children traveling on the same trip.
      • NOTE 4: For international flights (including Canada), the applicable surcharge for escort service also apply.
      • NOTE 5: The escort service surcharge is waived for children who have obtained MVP Gold or MVP status.
      1. Applicable to unaccompanied children 13-17 years old only: the above escort service may be requested when making a connection enroute. The USD 75.00 surcharge will apply.
      2. For the purpose of this rule, escort services means that AS will provide supervision for the person from the time of boarding until the person is met at the stopover point or destination.
      3. The age limits referred to in this rule shall be those in effect on the date of commencement of carriage.
